PT EXCELLENCE GmbH (hereinafter referred to as PT EXCELLENCE) attaches great importance to the protection of your privacy. Please note the following data protection provisions.

2 Scope

PT EXCELLENCE collects, processes, stores and protects the data of individuals who access its website. This Privacy Policy applies to this website and all its applications and functions such as chat, newsletters, events, etc..

3 Legal Bases

These data protection principles are based on the Swiss Data Protection Act (DSG) and the European Data Protection Ordinance (DSGVO).

4 Responsibility at PT EXCELLENCE

Thomas W. Liedtke (owner) & Yves-Patrick Magron (owner): info(at)pt-excellence.com is responsible for all data protection concerns at PT EXCELLENCE.

5 Use of information

Visiting the PT EXCELLENCE website is basically possible without providing any personal data. Impersonal usage data such as the IP address, the browser used, date, time, etc. are evaluated without any conclusions as to your person. Visitors to our website can also activate the "do not track" function on their browser, so that only the login itself is tracked. Personal data is collected and processed strictly in accordance with the relevant laws and regulations and only with your express consent.

6 No disclosure of personal data

Your personal data will neither be sold nor shared with third parties outside PT EXCELLENCE. An exception may be external service providers who process enquiries or orders (e.g. for studies or white papers) on behalf of PT EXCELLENCE and process the data required for this purpose. PT EXCELLENCE guarantees that all data receiving offices meet the requirements of data protection and data security.

7 To contact us via the website

If you contact PT EXCELLENCE via our website, the personal data you provide will be stored automatically. Such data transmitted on a voluntary basis will be stored for the purpose of processing or contacting you. This personal data will not be passed on to third parties.

8 Comment and debate function

On our website you can participate in interactive forums such as chat, blog, message board and other platforms. You have the opportunity to leave individual comments on posts from other visitors as well as debate specific topics. These comments may in turn be commented on by third parties. If a data subject leaves a comment on an article or comment published on this website, in addition to the corresponding comment, information about the time the comment was entered and the name of the data subject (clear name obligation) will be stored and published. In addition, the IP address assigned by the Internet service provider to the person concerned is logged. This IP address is stored for security reasons and in the event that a comment violates the rights of third parties or illegal content is posted. These collected personal data will not be passed on to third parties unless such a passing on is legally prescribed or serves to defend the rights of those responsible.

9 Routine deletion and blocking of personal data

PT EXCELLENCE processes and stores the personal data of the persons concerned only for the period of time necessary to achieve the storage purpose, or if this was provided for by statutory provisions to which the persons responsible are subject. If the storage purpose no longer applies or if any statutory storage period expires, the personal data shall be blocked or deleted routinely and in accordance with the statutory provisions.

10 Legal basis for processing

No data will be processed without a legal basis. As such serve:

  • the consent

  • the performance of a contract

  • statutory obligations

  • the safeguarding of a legitimate interest of PT EXCELLENCE or a third party

11 Rights of data subjects
a) Right of confirmation

Any data subject shall have the right to obtain from those responsible confirmation as to whether personal data relating to him or her are being processed. If a data subject wishes to exercise this right of confirmation, he or she may at any time contact the person(s) responsible at PT EXCELLENCE.

b) Right of information

Any person concerned by the processing of personal data has the right at any time to obtain from the data controllers free information on the personal data relating to him which have been stored and a copy of that information. Information will be provided on:

  • the processing purposes,

  • the categories of personal data to be processed,

  • the recipients or categories of recipients to whom the personal data have been or will be disclosed

  • whether personal data have been transferred to a third country or to an international organisation and, if so, whether appropriate safeguards exist in relation to the transfer,

  • the planned storage period or, if this is not possible, the criteria for determining that period,

  • the existence of a right to the rectification or erasure of personal data concerning him or her or to the limitation of the processing by the controller or the existence of a right to object to such processing,

  • the existence of a right of appeal to a supervisory authority,

  • the origin of the personal data, if they are not collected from the data subject,

  • the existence of automated decision-making, including profiling and meaningful information on the logic involved and the scope and intended impact of such processing on the data subject. If a data subject wishes to exercise this right of access, he or she may at any time contact the person(s) responsible at PT EXCELLENCE.

c) Right to rectification

Any person concerned by the processing of personal data has the right to obtain the rectification without delay of inaccurate personal data concerning him or her and, having regard to the purposes of the processing, the completion of incomplete personal data. If a data subject wishes to exercise this right of rectification, he or she may at any time contact the person responsible at PT EXCELLENCE.

d) Right to deletion (right to be forgotten)

Any person data subject to the processing of personal data shall have the right to obtain from the controllers the immediate erasure of personal data relating to him or her, where one of the following reasons applies and where the processing is not necessary:

  • The personal data have been collected for such purposes or processed in any other way for which they are no longer necessary.

  • The data subject withdraws the consent on which the processing was based and there is no other legal basis for the processing.

  • The data subject objects to the processing and there are no overriding legitimate reasons for the processing.

  • The deletion of personal data is necessary to fulfil a legal obligation.

  • The personal data relate to a child under 16 years of age or who does not have the consent of the holder of parental authority.

If one of the reasons given above applies and a data subject wishes to have personal data stored by those responsible deleted, he or she may at any time contact the person(s) responsible at PT EXCELLENCE. If the personal data have been made public by the data processors and the data processors are obliged to delete the personal data, the data processors shall take appropriate measures, including technical measures, taking into account the technology available and the implementation costs, to inform other data processors who process the published personal data that the data subject has requested the deletion of all links to these personal data or copies or replications of these personal data from these other data processors, insofar as the processing is not necessary.

e) Right to limitation of processing

Any person concerned by the processing of personal data shall have the right to request the controllers to limit the processing if one of the following conditions is met:

  • The accuracy of the personal data is contested by the data subject for a period of time which enables the data processors to verify the accuracy of the personal data.

  • The processing is unlawful and the data subject refuses to delete the personal data and instead requests that the use of the personal data be restricted.

  • The controller no longer needs the personal data for the purposes of processing, but the data subject needs them for the assertion, exercise or defence of legal rights.

  • The data subject has objected to the processing and it is not yet clear whether the legitimate reasons of the controllers outweigh those of the data subject.

If one of the above conditions is met and a data subject wishes to request the limitation of personal data held by those responsible, he/she may at any time contact the person(s) responsible at PT EXCELLENCE.

f) Right to data transferability

Any data subject involved in the processing of personal data has the right to obtain personal data concerning him or her provided by the data subject to the controllers in a structured, common and machine-readable format. It shall also have the right to communicate such data to another data processor without being hampered by the controllers to whom the personal data have been disclosed, provided that the processing is based on consent or on a contract and that the processing is carried out by automated means, unless the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller. The data subject may also request that the personal data be transferred directly from one data processor to another, provided that this is technically feasible and does not infringe the rights and freedoms of others. In order to assert the right to data transfer, the person concerned may at any time contact the person(s) responsible at PT EXCELLENCE.

g) Right to appeal

Any person concerned by the processing of personal data has the right to object at any time to the processing of personal data concerning him or her. This also applies to profiling based on these provisions. In the event of opposition, data controllers shall no longer process personal data unless compelling legitimate reasons for the processing can be demonstrated which override the interests, rights and freedoms of the data subject or the processing is for the exercise, exercise or defence of legal rights. In order to exercise the right of opposition, the data subject may apply directly to the person(s) responsible at PT EXCELLENCE.

h) Automated decisions in individual cases including profiling

Any person data subject to the processing of personal data shall have the right not to be subject to a decision based solely on automated processing, including profiling, which has legal effects upon him or her or significantly affects him or her in a similar manner, unless the decision is necessary for the conclusion or performance of a contract between the data subject and the data controllers or with the express consent of the data subject. Where the decision is necessary for the conclusion or performance of a contract between the data subject and the data subjects, or with the express consent of the data subject, the data subjects shall take reasonable measures to safeguard the rights and freedoms and the legitimate interests of the data subject, including at least the right to obtain intervention by the data subjects, to present their views and to contest the decision. If the data subject wishes to exercise his/her rights with regard to automated decisions, he/she may at any time contact the person(s) responsible at PT EXCELLENCE.

i) Right to revoke consent under data protection law

Any person concerned by the processing of personal data has the right to withdraw consent to the processing of personal data at any time. If the data subject wishes to exercise his/her right to withdraw his/her consent, he/she may at any time contact the employees of the data controllers.

j) Right of appeal to a supervisory authority

Any person concerned by the processing of personal data has the right to complain to the local supervisory authority responsible for the protection of citizens' personal data about the data protection infringements committed by the data controllers.

12 Linking to other websites

The PT EXCELLENCE website links to other websites for whose content it is not responsible.

13 Collection, processing and use of personal data

13.1 Personal data

Personal data is information about the factual or personal circumstances of a specific or identifiable natural person. This includes, for example, your name and e-mail address, telephone number and address.

13.2 Use of your data for advertising purposes

In addition to the use of your data for the newsletter dispatch, we also use your data to show you personalized advertising.

13.3 Newsletter

For the dispatch of the newsletter we use the so-called double opt-in procedure, i.e. we will only send you a newsletter by e-mail if you have expressly confirmed to us beforehand that we should activate the newsletter service. We will then send you a notification e-mail and ask you to confirm that you wish to receive our newsletter by clicking on a link contained in this e-mail. If you do not wish to receive our newsletter at a later date, you can unsubscribe at any time. You will find a unsubscribe link in each newsletter.

13.4 Service recommendations via email

As a PT EXCELLENCE customer, you will occasionally receive product or service recommendations from us by e-mail. You will receive these recommendations from us regardless of whether you have subscribed to a newsletter or not. In this way, we want to send you information about products from our range that might be of interest to you on the basis of your last service purchases from us. We strictly adhere to the legal requirements. If you no longer wish to receive product recommendations or advertising messages from us, you can object to this at any time without incurring any costs other than the transmission costs according to the basic tariffs. An email to the contact data mentioned under point 4 (e.g. email, fax, letter) is sufficient for this. Of course, you will also find a unsubscribe link in every e-mail.

13.5 Individual advertising for you

The information we receive from you helps us to permanently improve your service experience and to make it customer-friendly and individual for you. The information you submit and automatically generate is used to create advertisements that are tailored to you and your interests. We use existing information for this purpose, such as confirmations of receipt and reading of e-mails, information about computers and connections to the Internet, operating system and platform, your service history, date and time of visit to the homepage, articles, topics and content that you have viewed. We use this information exclusively in pseudonymised form. Through the analysis and evaluation of this information, it is possible for us to improve our web pages and our Internet offer, and thereby to send you individual advertising. This means advertising that recommends services that might actually interest you. Our aim is to make our advertising more useful and interesting for you. Therefore, the evaluation and analysis of the pseudonymised data collected from you helps us to ensure that we do not send you random advertisements. Rather, we send you advertising, such as newsletters, service recommendations, by e-mail or letter advertising, which correspond to your areas of interest. In this respect, we also compare, for example, which of our advertising e-mails you open in order to avoid unnecessary e-mails being sent to you.

13.6 Sweepstakes, market research & public opinion polling

In lotteries we use your data for the purpose of winning notification and advertising for our offers. Detailed information can be found in our conditions of participation for the respective lottery. We also use your data for market and opinion research. Of course, we use this data exclusively anonymously for statistical purposes and only for PT EXCELLENCE. Your answers to surveys will not be passed on to third parties or published. PT EXCELLENCE uses and processes your personal data for market and opinion research exclusively for its own purposes.

14 Cookies

This website uses cookies. Cookies are small text files that are stored permanently or temporarily when you visit this website. The purpose of cookies is, in particular, to analyse the use of this website for statistical purposes and for continuous improvement. You can deactivate cookies completely or partially at any time in the settings of your browser. If cookies are deactivated, all functions of this website may no longer be available to you.

14.1 What are cookies ?

Cookies are small files which are stored on your data carrier and which store certain settings and data for exchange with our system via your browser. Basically, there are two different types of cookies, so-called session cookies, which are deleted as soon as you close your browser, and temporary/permanent cookies, which are stored on your data carrier for a longer period of time or indefinitely. This storage helps us to design our web pages and our offers accordingly for you and makes it easier for you to use them, for example by saving certain entries in such a way that you do not have to repeat them all the time.

14.2 What cookies does PT EXCELLENCE use?

Most of the cookies that we use are automatically deleted from your hard drive at the end of the browser session (end of session) (hence session cookies). In addition, we also use cookies that remain on your hard drive. During a further visit, it is then automatically recognised that you have already been to our site and which entries and settings you prefer. These temporary or permanent cookies (lifetime 1 month to 10 years) are stored on your hard drive and delete themselves after the specified time. In particular, these cookies serve to make our offer more user-friendly, effective and secure. Thanks to these files, it is possible, for example, for you to be shown information on the site that is specifically tailored to your interests. The exclusive purpose of these cookies is to adapt our offer to your customer wishes in the best possible way and to make surfing with us as comfortable as possible for you.

14.3 What data is stored in the cookies?

The cookies used by PT EXCELLENCE only store pseudonymous data. When the cookie is activated, it is assigned an identification number and your personal data is not assigned to this identification number. Your name, IP address or similar data, which would enable the cookie to be assigned to you, are not placed in the cookie. On the basis of the cookie technology, we only receive pseudonymised information, for example about which pages of our website were visited, which services, articles or cases were viewed, etc. We do not use cookies for this purpose.

14.4 What is Onsite Targeting?

On the PT EXCELLENCE website, data is collected on the basis of cookie technology to optimise our advertising and the entire online offering. This data is not used to identify you personally, but is used solely for a pseudonymous evaluation of the use of the homepage. Your data will at no time be merged with the personal data stored by us. With this technology, we can present you with advertising and/or special offers and services whose content is based on the information obtained in connection with the clickstream analysis (for example, advertising aimed at the fact that in recent days only content on topics such as digital marketing or media relations was viewed). Our aim is to make our online offering as attractive as possible for you and to present you with advertising that corresponds to your areas of interest.

14.5 Are there third party cookies? (so-called Third Party Cookies)?

PT EXCELLENCE uses a number of advertising partners to help make the Internet offering and our website more interesting for you. For this reason, cookies from partner companies are also stored on your hard drive when you visit the websites. These are temporary/permanent cookies that are automatically deleted after the specified time. These temporary or also permanent cookies (lifetime 14 days to 10 years) are stored on your hard disk and delete themselves after the given time automatically. The cookies of our partner companies also contain only pseudonymous, mostly even anonymous data. This includes, for example, data on which products you have viewed, whether something has been purchased, which products have been searched for, etc. Some of our advertising partners also collect information about which pages you have visited before or which products you have been interested in, for example, in order to be able to show you the advertising that best suits your interests. This pseudonymous data is at no time combined with your personal data. Their sole purpose is to enable our advertising partners to address you with advertising that might actually be of interest to you.

14.6 Re-Targeting

Our websites use so-called re-targeting technologies for this purpose. We use these technologies to make the website more interesting for you. This technology makes it possible to address Internet users who have already shown interest in our website and the offers presented there with advertising on the websites of our partners. We are convinced that the insertion of personalized, interest-related advertising is generally more interesting for the Internet user than advertising that has no such personal reference. The insertion of these advertising media on the pages of our partners is based on cookie technology and an analysis of previous usage behaviour. This form of advertising is completely pseudonymous. No user profiles are merged with your personal data. By using our site, you consent to the use of so-called cookies and to the collection, storage and use of usage data by you. Furthermore, your data is stored in cookies beyond the end of the browser session and can be retrieved, for example, on your next visits to the web pages. You can revoke this consent at any time with effect for the future by refusing to accept cookies in your browser settings.

14.7 How can you prevent the storage of cookies?

You can set your browser to only accept cookies if you agree. If you only want to accept the PT EXCELLENCE cookies but not the cookies of our service providers and partners, you can set your browser to "Block third-party cookies". As a rule, the Help function in the menu bar of your web browser shows you how to reject new cookies and how to deactivate cookies that have already been received. Detailed information on how to configure the settings in the browser you are using can be found under the following link: https://support.norton.com/sp/de/de/home/current/solutions/v57840314_NortonM_Retail_1_en_en. We recommend that you always log out completely after you have finished using shared computers that are set to accept cookies and flash cookies.

15 Log-Data

Each time you access the PT EXCELLENCE pages, usage data is transmitted by the respective Internet browser and stored in log files, the so-called server log files. The data records stored contain the following data: Date and time of the retrieval, name of the retrieved page, IP address, referrer URL (URL from which you came to the website), the amount of data transmitted, as well as product and version information of the browser used. The IP addresses of the users will be deleted or anonymised after the end of their use. In the case of anonymisation, the IP addresses are changed in such a way that the individual details about personal or factual circumstances can no longer be allocated to a specific or identifiable natural person, or can only be allocated with a disproportionately large expenditure of time, money and labour. We evaluate these log file data records in anonymous form in order to further improve our services and make them more user-friendly, to find and correct errors more quickly and to control server capacities. For example, it can be tracked at which time the use of the PT EXCELLENCE website is particularly popular and provide corresponding data volume to ensure you the fastest possible shopping. In addition, an analysis of the log files enables us to identify and correct any errors on the PT EXCELLENCE website more quickly.

16 Web Analysis

16.1 Google Analytics

Google Analytics is a service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site. The information collected by the cookie about your use of our website (including your IP address) will generally be transmitted to and stored by Google on servers in the United States. We would like to point out that on our web pages Google Analytics has been extended by the code "gat._anonymizeIp();;" in order to guarantee an anonymous recording of IP addresses (so-called IP masking). At our request, Google will therefore only record your IP address in abbreviated form, which guarantees anonymisation and does not allow any conclusions to be drawn about your identity. If IP anonymisation is activated on our websites, Google will shorten your IP address beforehand within member states of the European Union or other states party to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to and truncated by Google on servers in the United States. Google will use this information to evaluate your use of our websites, to compile reports on website activity for us and to provide us with other services relating to the use of websites and the internet. The IP address transmitted by your browser as part of Google Analytics is not combined with other data from Google. A transfer of this data by Google to third parties only takes place due to legal regulations or in the context of order data processing. Under no circumstances will Google combine your data with other data collected by Google. By using this website, you consent to the processing of data about you by Google and the manner of data processing and purpose set out above. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of our website. In addition, you can prevent Google from collecting the data generated by the cookie and related to your use of these web pages (including your IP address) and Google from processing this data by downloading and installing the browser plug-in available under the following link. Further information on Google Analytics and data protection can be found at: http://tools.google.com/dlpage/gaoptout?hl=en.

16.2 Google Remarketing Day

We use the Google Remarketing tag to re-target ads on Google AdWords, Google Display Network and YouTube based on your activities on our website to match your interests.

16.3 Linkedin pixels

We use LinkedIn pixels to re-target ads on LinkedIn to match your interests based on your activities on our site.

17 Social Plugins

Our website uses social plugins ("plugins") from various social networks. With the help of these plugins you can, for example, share content or recommend products. The plugins are activated by default on pt-excellence.com. The content of the plugin is transmitted directly from the social network to your browser and integrated into the website by it. Through the integration of the plugins, the social network receives the information that you have called the corresponding page of our website. If you are logged in to the social network, it can assign the visit to your account. If you interact with the plugins, for example by clicking on the Facebook "Like" button or making a comment, the corresponding information is transmitted directly from your browser to the social network and stored there. The purpose and scope of the data collection and the further processing and use of the data by social networks as well as your rights in this regard and setting options for the protection of your privacy can be found in the data protection information of the respective networks or websites. Even if you are not registered with the social networks, websites with active social plugins can send data to the networks. An active plugin sets a cookie with an identifier each time you access the website. Since your browser sends this cookie each time you connect to a network server without being asked, the network could in principle use it to create a profile of which web pages the user belonging to the identifier has visited. And it would then also be possible to assign this identifier to a person again later - for example when logging on to the social network later. On our websites we use the following plugins: Facebook, Twitter and LinkedIn. If you do not want social networks to collect data about you via active plugins, you can select the "Block third-party cookies" function in your browser settings. Then the browser will not send cookies to the server for embedded third-party content. With this setting, however, other functions than plug-ins may no longer work.

17.1 LinkedIn

We use plugins of the social network LinkedIn, which is operated by LinkedIn Ireland U.C.. The link to LinkedIn's privacy policy can be found here: LinkedIn Privacy Policy.
